Parenting Plans and Time-Sharing in Tarpon Springs
Florida did away with the concepts of Custody and Visitation in 2008 when it changed the statutes to reflect a desire for both parents to share more evenly their time with the children. When parents divorce, closely intertwined with the divorce proceedings is the issue of parenting and time-sharing with each parent frequently seeking to obtain the majority of the time-sharing for the children.
Under Florida family laws, divorcing parents are required to execute a parenting plan, which outlines the rules for their co-parenting of their children. The Parenting Plan covers a wide range of issues from decision making about schools and medical issues to extra-curricular activities to transportation to travel out of state or out of the country, to name a few. Most importantly, the Parenting Plan will contain the Time-Sharing schedule for the children, which details when the child will be with each parent during the school year, the summer, and for Christmas and other major holidays.
If the parties are unable to agree on a parenting plan, the family law court can issue orders on custody and visitation. This may award parenting time to both or sole parental responsibility to only one parent, in accordance with the child’s best interests. The court may assign parental responsibility to each parent who will have the right to make decisions involving the child’s education, health care, and other such matters relevant to the child’s situation.
Discussing a parenting agreement can be a challenge when parties harbor ill feelings for each other. A family law attorney who understands your concerns and has experience in negotiating parenting agreements even in high conflict situations can help you obtain the best possible outcome for you and your child.
